■ video banned from courtroom (26-9-2011) jurors in the involuntary manslaughter trial of dr. conrad murray, which gets underway tuesday morning, will not be viewing the video of micheal jackson announcing his this is it concert series three months before he died, a judge ruled today. attorneys for the prosecution and defense met today with superior court judge michael pastor to discuss pending motions before the trial gets underway. murray's lawyers unsuccessfully lobbied to use the video of jackson's press conference given in march 2009 to announce his this is it tour as evidence in the case. attorney nareg gourjian argued that the video showed jackson under a lot of pressure and hung over. the defense wanted to use the footage to argue that jackson was not physically fit and that he had agreed to 10 shows, not 50. however, judge pastor banned the video saying the footage was not relevant to jackson's death. pastor also denied a motion by the prosecution to enter evidence that law enforcement tried four times to get a follow-up interview with murray but to no avail. the prosecution will likely argue that murray was uncooperative with investigators. legal experts also believe prosecutors will attack murray for having waited to report to police that he had given jackson propofol. the prosecution is basically going to say that this was entirely reckless conduct, that he should never have been giving michael jackson propofol [and] never should have walked out of the room for as long as he did, said dan abrams, abc news' legal analyst. source: mjfc / abcnews.go.com

■ urgent plea for testing in mj death case (27-10-2010) arguing that evidence is quickly deteriorating, defense lawyers for the doctor charged in michael jackson's death are seeking urgent testing of two syringes and an iv bag found in the singer's mansion after his death. attorneys for dr. conrad murray said during a 40-minute closed session with a judge that liquids in one of the syringes had already dried up and was now salt, according to a transcript of the proceeding obtained wednesday by the associated press. quantities of substances in the syringes and iv bag could be crucial to explaining how the singer died, the lawyers said at the tuesday hearing. according to the transcript, officials tested what was in the items and found traces of propofol and lidocaine, but the amounts of the substances were not determined, and defense attorneys contend that may be significant in the case, which is expected to hinge on technical and scientific data. however, authorities contend that murray administered a lethal dose of sedatives, including the anesthetic propofol, to jackson in the bedroom of his rented mansion in june 2009. superior court judge michael pastor declined to order testing on the substances tuesday because he wanted defense attorneys to confer further with prosecutors. the judge may order the testing late next week if the two sides can agree on how it will be conducted. i want to act as quickly as we can, pastor told the attorneys. still, defense attorney ed chernoff struck an urgent tone, telling the judge, we are doing it because the house is on fire. we need a hose. chernoff said substances in one broken syringe found at the mansion had dried up since june 2009, when pastor ordered the evidence preserved. the tests sought by murray's attorneys will destroy the samples and can only be performed once. prosecutor david walgren questioned why defense attorneys had not raised the issue sooner. defense attorney j. michael flanagan told the judge his efforts to get the substances tested has been delayed because an expert in the los angeles coroner's office had been on a lengthy vacation. he argued the tests should have been done directly after jackson's death. it hasn't been done yet, flanagan said. it should have been done a year ago. flanagan said he was told by the coroner's office that the makeup of the liquids in the syringes and iv bag were not tested because the values were not necessary to establish the cause of jackson's death. flanagan said in the closed session that the results of the tests would be very helpful information perhaps for both sides. tissue samples in jackson's body were tested for levels of various substances and led to the coroner's determination that the superstar died in part from acute propofol intoxication. the anesthetic is supposed to be administered only in a hospital setting, but murray told investigators he had been providing it to jackson as a sleep aide and had been trying to wean him off the drug. chernoff told the judge results of the testing, which may take a month or more to complete, would not be used during a preliminary hearing scheduled to begin jan. 4. prosecutors will lay out some of their evidence during the hearing, and pastor will then decide whether there is enough evidence to order murray to stand trial. source: mjfc / ap / thanks to juliana for bringing this to our attention.

■ charles thomson defends mj (17-11-2010) last tuesday, november 9th, british writer, charles thomson posted a blog chastising kelvin mackenzie, the former editor of the sun newspaper. mackenzie appeared on the british tv show, 'this morning' and said that michael jackson was a child molester and his children are better off now that he's dead. if that wasn't bad enough, he added that he couldn't understand why the children had been born at all. thomson called mackenzie's remarks morally and ethically reprehensible and said he demonstrated a complete lack of respect for the justice system and also for the ethics of his profession. thomson also pointed out that mackenzie is a bigot and was in charge of the sun back in the 1980's when the paper coined the derogatory, highly offensive term 'wacko jacko.' he then urged fans to complain directly to the television show and the broadcast company. a few days later, on november 13th, thomson posted another blog after michael's nephew, taj jackson entered into the fray over mackenzie's comments. jackson took to his twitter page about the incident, re-posting links to articles about mackenzie's statements. the then wrote, if we don't get an on air apology from itv soon, my next step is legal. the time for bad mouthing & spreading lies about my uncle are over. jackson then urged his 20,000 followers to complain to the station. the station has since been bombarded with complaints by way of emails and phone calls from all over the world and at least one caller was told that the complaints were being looked into. to read the full blogs posted by mr. thomson, please click here and here . source: mjfc / charlesthomsonjournalist.blogspot.com / special thanks to joe for bringing this to our attention!

■ murray meets with legal team (3-2-2-2010) michael jackson's physician has been strategizing with his team of defense attorneys and is ready to surrender to authorities if prosecutors file charges, the doctor's attorney said. dr. conrad murray, who has a practice in houston, came to los angeles last weekend and spent tuesday afternoon meeting with his newly assembled team of three lawyers. the district attorney's office has not said if it will file charges but lead defense attorney ed chernoff said murray is ready for such a move. i haven't received any phone call from anybody asking for the doctor to surrender, chernoff said. if we get the call, we'll be happy to. david walgren, the deputy los angeles county district attorney handling the case, declined to comment. jackson, 50, hired murray to be his personal physician as he prepared for a strenuous series of comeback performances in london. his death on june 25 in los angeles came after murray, tending to jackson in the star's rented mansion, administered the powerful anesthetic propofol and two other sedatives to get the chronic insomniac to sleep, according to the los angeles county coroner's office, which ruled the death a homicide. propofol is only supposed to be administered by an anesthesia professional in a medical setting. the patient requires constant monitoring because the drug depresses breathing and heart rate while also lowering blood pressure, a potentially deadly combination. murray, a cardiologist, has maintained from the outset that nothing he gave the singer should have killed him. administering propofol to jackson wasn't illegal, so prosecutors must show murray deviated from accepted medical norms when he administered it in a non-medical setting while jackson already had other sedatives in his system. a law enforcement official last month told the ap that prosecutors had decided to seek a grand jury indictment on an involuntary manslaughter charge. on tuesday, a second law enforcement official said prosecutors were sticking with the charge but planned to file a criminal complaint to avoid the appearance of secrecy in the closely watched case. both officials requested anonymity because they are not authorized to publicly discuss the case. while there is no public timetable for charges to be filed against murray, there are strong indications the move is imminent. jackson attorney brian oxman said wednesday that the pop star's family believes an involuntary manslaughter charge would be insufficient. brian oxman told cbs' the early show on wednesday that murray displayed recklessness in dispensing the drugs, warranting a second-degree murder charge. involuntary manslaughter, with its maximum jail sentence of four years, would be just a slap on the wrist, he said.
