    • Will The Compact Clause Trump The Tobacco Settlement?
There's a good backgrounder over at Balkinization on how the Supreme Court could invalidate the 1997 tobacco settlement as a violation of the Compact Clause of the U.S. Constitution. The author, Michael Greve, is the J.D. Searle Scholar at the American Enterprise Institute, so liberals and pragmatists of all stripes can cue the laugh track. Another quixotic right-wing attack on established law, right? 最高裁判所は合衆国憲法のコンパクト節の規定に違反し、1997年タバコ決済を無効にする方法についてBalkinizationでにわたって良好な背景がある

    • The Canadian Election - Extraordinary times in the Normally Quiet North
Wow! Exciting times in the normally dull North of the Border.   Typical Forbes readers view most world events thru the lens of business and as a business professor I do to.  So what does Stephen Harper's reelection as Prime Minster, this time with a solid majority, rather than minority government, mean for business?  The first blush look suggests that business, Canadian and those who invest here, can sleep a bit easier tonight. As the biggest exporter and importer partner of the U.S. and a major source of energy, both oil and hydro, this election is actually somewhat important to American readers.   Now that he has a majority government Prime Minister Harper can take forward his conservative agenda, which, by-in-large will be good for business. In his five years as Prime Minister, albeit with a minority government, he has proven to be a pragmatist, I suspect that he will continue in that mode. An area which may well impact Canadian/U.S. relations will be the oil flowing from the Oil Sands of Alberta, the province from which Prime Minister Harper grew up in and now represents in Parliament.   うわー!境界線の通常鈍い北朝鮮に時間をエキサイティング

    • Michael Tomasky: Off-topic post on the limits of the interwebs
It's a quiet Friday afternoon around my parts, so I was reading through Arts & Letters Daily, the fine US cultural news and reviews site. I saw they'd flagged something about Matisse involving Guillaume Apollinaire, the famous early 20th-century art critic who was one of Matisse's champions. I didn't click through because I just didn't feel like getting into it at 4 pm on a Friday. But it did remind me of a short poem I dearly love, Tristan Tzara's The Death of Apollinaire. So I went to Google it, just to read it for the first time in several years. As best as I could determine, it is not online. There is this, the first thing that comes up, in which a male American voice reads it as a fixed camera contemplates a winter tree against a slate sky as birds float in and out of the picture. But I couldn't find it in print (as it were) online at all. This question of the limits of the internet has been an interesting one to me for some time. Some years ago, when the intertubes were still fairly young, a friend and I were on the phone and we got to talking about things one might not be able to find on the web. We started naming obscure rock musicians to each other. They were all there, though, until we hit upon Carmen Appice, the drummer for Vanilla Fudge back in the day. Yes, we're pretty deep into it, this buddy and I.And lo and behold he wasn't on the web. I can't say when this was. Around 2000, maybe. Now, of course, he's all over the place. He has a Wiki entry, and, natch, his own web site. So there's an old limit conquered. But now I seem to have tripped across a new one. An extremely rare occurrence in this day and age.So tell the rest of us - on what subject have you reached the limits of the internet? And I don't mean, obviously, that you just couldn't find something th それは私の部分の周り静かな金曜日の午後なので、私は芸術&文学毎日を通じて、上質なアメリカの文化ニュースやレビューサイトを読んでいた

    • From the archive, 12 November 1992:The Synod casts the final vote
First published in the Guardian on 12 November 1992Indefinite postponement was not an option. Divisions over the ordination of women priests in the Anglican Church were known to run deep, but the Synod was right at last to seek a practical resolution. The issue has been vigorously debated for almost 20 years. A decision in principle to open the Church to women priests was taken almost a decade ago. All the arguments heard yesterday had been aired before: the danger of schism on one side, the risk of increasing irrelevance on the other. The previous Archbishop of Canterbury, Dr Runcie, zealously pursued consensus. But here was an issue on which there was not going to be any possibility of consensual agreement for many more weary decades. There had to be a democratic test.In the end, the pragmatists won. By just two votes in the House of Laity – after Archbishop Carey pointed to what would happen if the Church did not open its doors: society would turn its back, and the Church would not be heard. A Church with a mission needed to draw on all available talent. Those comments were echoed by the Bishop of Birmingham, Mark Santer, whose conclusive argument was that unbelievers could not understand why priests could only be men.Was this just a secular battle fought in ecclesiastical language? Of course not, even though the Church, like all other institutions, cannot seal itself off from social change. A secular newspaper cannot presume to set down a definitive interpretation of complex theological texts, but the scholars who argue that the use of the word 'man' in Greek and Latin texts of the scriptures refers to mankind, not gender, are surely persuasive. The fact that Jesus only selected men as his disciples merely conformed to the social mores of the time.A ballot is always 11月12日1992Indefinite延期ガーディアン紙に掲載さまず、選択肢ではありませんでした
