Do you believe that the public should be protected from dangerous or persistent criminals? Do you believe that it is more effective and productive to reform criminals than it is to merely punish them? And do you believe that penalties for criminal behaviour should be sufficient to deter people from engaging in it?My guess is that most people would answer yes to all four questions. In doing so they would agree that each of four most common justifications for punishment – retribution, reform, public protection and deterrence – have something in them. Most differences of opinion only emerge when you try to work out their relative importance.Attempts to do that often make the false assumption that justice is one thing, the essence of which is real and discoverable. A better way to understand the fourfold theory of justice is that it shows that it is not one thing after all, but a composite of different elements. How important each one is depends on the particular circumstances. Determining this is an imperfect human endeavour, not something we can do with anything approaching mathematical precision. That may sound unsatisfactory, but it is better to muddle through knowing that is exactly what you're doing than it is to stride through the fog with the misguided belief that the road is clear. Justice is a messy business which works worse if we try to tidy it up too much.Such considerations have to borne in mind when we think about how to deal with young murderers like John Venables. Riot in Venezuelan prison kills 8 A riot among prisoners in a prison center near the capital Caracas killed eight people and injured three others on Tuesday.

Long prison sentences fail not just offenders, but society too The tough US sentencing model appeals to the vengeance-hungry British press, but rehabilitation is the key to tacking crimeWhen the Ministry of Justice (MoJ) released figures this month comparing reoffending rates, commentators fell over each other jumping to conclusions. According to the MoJ, longer sentences (of two to four years) resulted in a lower rate of reoffending than shorter sentences. Community orders and suspended sentences also led to less reoffending than sentences of under a year, but most newspapers chose to ignore any fact which might have obstructed their inalienable right to call for stiffer sentencing.The biggest predictor of reoffending is not length of sentence but age. Inmates released after a four-year term are older and their offending goes down accordingly. They have also had the benefit of interventions which those serving short sentences do not enjoy. In addition, they are supported on release by an offender manager.The MoJ research could have confounded the pundits if it had investigated other factors. For instance, when services are extended to provide help finding jobs and housing on release, reoffending drops. This is true whatever the length of sentence. It is also proven that facilitating consistent family contact during a sentence increases the chance of successful resettlement: this, too, is unrelated to length of sentence.Since the figures prompted predictable calls for more sentences, longer sentences and tougher jails, let's look at a nation where exactly that formula has been applied. The US began to follow the path now prescribed by British commentators at the end of the last century.Where has it led them? Well, first to the highest incarceration rate in the world. Letters: Legal cuts threaten access to justice Last Wednesday the case against our client Alan Clough was dropped after crucial video footage emerged. This showed him acting quite lawfully and then being punched in the face by a police officer (Inquiry after police hit anti-fascist protester, 22 October). Mr Clough was due to stand trial on a public order offence after he attended a protest against the English Defence League in Bolton in March. We represented many people arrested on that demonstration and have received many reports of oppressive tactics and arbitrary violence by the police. The original police account of the day, widely reported in the media, was that officers acted with professionalism and restraint in the face of extreme violence from demonstrators. It has taken many months of digging by lawyers and campaigners for a more accurate picture to emerge. In Mr Clough's case, without the video footage there is every possibility that the court would have accepted the accounts of the officers and a miscarriage of justice would have occurred.It is a basic principle of a democratic society that those accused of a crime are able to have their case brought promptly before a court and have access to quality legal representation. Mr Clough's case shows that we cannot always trust state authorities to act with fairness and transparency. The role of a legal aid lawyer can often be decisive in preventing a miscarriage of justice. Spending cuts at the Ministry of Justice will lead to more delays, inefficiency and mistakes. The £350m cut in legal aid will bring us closer to a scenario where there is one law for the rich and one law for the poor.
