Morocco must leave Western Sahara | John Hilary Prince Charles's visit to Morocco is a chance to put pressure on King Mohammed to end the brutal occupation of Western SaharaPrince Charles and Camilla are soon to arrive in Morocco on an official visit intended to boost trade and cultural ties with Britain. The Foreign Office has advised that recent unrest in Morocco poses no threat to the royal couple, following King Mohammed VI's announcement of a programme of reforms designed to appease protesters.Yet a serious question mark hangs over the British government's judgment in agreeing to the royal visit, given Morocco's continuing occupation of Western Sahara and the worsening human rights situation there.Morocco has not been immune from the wave of rebellion that has swept across north Africa in recent weeks. Major demonstrations have called for increased civil rights and for constitutional reforms to restrict the power of the monarchy. Teachers' unions have been joined by students in a series of strikes and occupations in protest at state education policy. In response to the protests, Mohammed VI has announced a process of constitutional change that is supposed to lead eventually to a popular referendum. Yet there remains scepticism as to how far the king is prepared to go in meeting the reform agenda.Press freedom, in particular, remains highly circumscribed, even if the means used to clamp down on critical media are sophisticated ones. The recent closure of the popular magazine Nichane shows how economic pressure can be just as effective as outright censorship in suppressing freedom of expression. There is no such subtlety when it comes to Morocco's military occupation of Western Sahara. Here Moroccan forces have waged a brutal war of repression against the Sahrawi people for the past 36 years. Sahrawis risk arrest, i

Kenya: clouds of doubt overshadow constitutional new dawn When President Mwai Kibaki exits in 2012, it will be in a changed political landscape marked by worries over a reshaped executive, limits on landholdings and abortion rightsWith Kenyans overwhelmingly voting to adopt a new constitution, the country is optimistic about a new dawn, just as it was in 2002 when the victory of the National Rainbow Coalition (Narc) party ended 24 years of President Daniel arap Moi's rule.According to the results released by Kenya's Interim Independent Electoral Commission, the yes vote won by 6.09 million votes against 2.8 million, a victory for President Mwai Kibaki and the prime minister, Raila Odinga.Though politicians will deny that the referendum had anything to do with the general election due in 2012, it has kickstarted the battle to replace Kibaki. The last referendum on constitutional change in 2005 showed that political ambitions always overshadow Kenya's best interests. Then, the team opposed to a new constitution won against the government, and it emboldened Raila Odinga, who was leading the opposing forces, to form the Orange Democratic Movement to contest the 2007 elections. He took the opportunity of successfully rallying Kenyans against Kibaki in the referendum as a test run for the country's top office. Now, with the passing of the new constitution, the president will not be eligible to stand again in 2012. Kibaki will exit a triumphant man, despite the damage to his reputation caused by the election in 2007, widely seen to have been rigged, and which led to the loss of 1,133 lives. He can enter the history books as the one who finally gave Kenyans a new constitution. The new set-up will change the political landscape. It puts Odinga in a strategic position to take over, and if Kibaki endorses him it will be a foregone conclusi

The Tories' human rights proposal is unclear and contradictory | Qudsi Rasheed In spite of his commission to consider a bill of rights, David Cameron has not come up with any real proposals for changeI have spent the last six months doing very little other than reading, listening to and considering the various political parties' proposals for the future of the Human Rights Act, a potential UK bill of rights and more generally, their attitude to human rights and civil liberties. I, like Afua Hirsch, was at the Times/Matrix Chambers debate last Tuesday evening. The problem for me is that I still don't quite understand what it is the Conservatives want to do and why.The Conservative party's approach to this issue has been cloak and dagger. The commission of lawyers set up by David Cameron to consider the bill of rights has been extremely secretive and none of its work has been published. Short of vague and often contradictory statements and political rhetoric by various members of the party, there has been very little in the way of concrete proposals and suggestions. And so no one quite knows what the proposal to scrap the HRA and replace it with a UK bill of rights is all about. Is it about giving more rights or fewer rights? Is about giving more power to judges or less? This clandestine method of putting forward proposals on what would be far-reaching and serious constitutional reform is problematic and can be attributed to one of two factors. The first is malicious. A UK bill of rights would be regressive and would diminish human rights protection. For fear of openly acknowledging this fact, it appears that it must be hidden away, a point raised by Shami Chakrabarti at the Times/Matrix debate. It is for this reason that JUSTICE has published seven conditions against which any proposalscan be judged. The second factor could be that the Conservatives

Pakistan's maturing democracy | Michael Meyer-Resende and Hannah Roberts Despite its violent, dysfunctional image, recent reforms have restored key features of the country's founding constitutionPakistan is widely portrayed as the perennial dysfunctional country, where weak elected governments are inevitably overthrown by a powerful army. The violence of recent years has strengthened the perception of a failing state, obscuring a more encouraging trend: the maturing of Pakistani democracy, demonstrated in parliament's adoption of far-reaching constitutional reforms. While the continuing violence poses a threat to Pakistan's development, there is also a risk that prophecies of a military takeover fulfil themselves, particularly in a context where the west badly needs Pakistan's army for its Afghanistan strategy.A comparison with Afghanistan illustrates the significance of Pakistan's reforms: President Hamid Karzai is trying to take control of the appointment of the electoral complaints commissioners, whose integrity was instrumental in curtailing the widespread fraud that marred his re-election last year.In Pakistan, the recent constitutional reforms reduce the president's discretion to appoint election commissioners by giving the opposition a voice in this process. However, the reforms go far beyond the issue of elections, restoring key features of the original constitution of 1973, adopted after the secession of East Pakistan, today's Bangladesh. The constitution foresaw a parliamentary system of government and significant competencies for the four provinces, but soon power shifted to the president, a trend that became even more marked under the periods of military rule by Muhammad Zia-Ul-Haq and Pervez Musharraf. The reform, known as the 18th amendment, moves powers from the president to the prime minister and parliament, and from the federal

Letter: Our fears for the fate of Ai Weiwei We write as a matter of urgency regarding the arbitrary detention of the Chinese artist Ai Weiwei (Report, 7 April). We and many Chinese and other friends are very concerned at the Chinese government's behaviour towards its own citizens. Ai Weiwei's position is that he firmly believes in the freedom of speech and the right to speak up on behalf of others who have been brutally silenced for their efforts to change society for the better. As an immediate priority we urge governments to exert strong pressure on China to treat its citizens with respect as a matter of basic justice and humanity. At this stage of China's development as a country taking an increasing part in world affairs, it is crucial that we make it clear that China's credibility in the world is at stake if it does not significantly improve its human rights record. For example, another artist, Wu Yuren, was released in Beijing on 3 April after being detained for nearly 11 months without trial. His wife and child were left in a state of great anxiety for his safety and welfare and he had committed no crime. Liu Xiaobo has been handed an 11-year sentence as a writer who expressed the need for constitutional reform in the Chinese political system. He has effectively been removed from society for more than 10 years for expressing his views. We are concerned that the same fate awaits Ai Weiwei. We urge the UK government to treat this case as an urgent priority and to press for his immediate release.Katie Hill (Curator and Lecturer, Chinese Contemporary Art)Cai Yuan (Artist)Ma Jian (Author, Beijing Coma)Jung Chang (author, Wild Swans)Jon Halliday (Historian)Craig Clunas (Professor of Art History, University of Oxford)Michael Stanley (Director, Modern Art Oxford)Jayne Parker (Head of Graduate Fine Art Media, Slade Sc 我々は、中国人アーティストアイウェイウェイの恣意的な拘禁(レポート年4月7日)に関する緊急の問題として書いてください

Sir Ellis Clarke obituary The first president of Trinidad and TobagoThe lawyer and diplomat Ellis Clarke, who has died aged 93, played a leading role when Trinidad and Tobago became an independent country in 1962. While governor general from 1972, he was involved in drafting the republican constitution that in 1976 broke ties with the British monarchy while retaining membership of the Commonwealth. As the Caribbean republic's first president, appointed under that new constitution by an electoral college, he helped guide it from 1976 to 1987.When Eric Williams, prime minister and founder of the People's National Movement (PNM), died in office in 1981, Clarke appointed his successor, George Chambers. Around 40% of the country's population of currently around 1.3m people are Afro-Trinidadian, 40% Indo-Trinidadian, and 20% mixed, white or of Chinese descent. Clarke was more at home with the Afro-Trinidadian-based PNM, and when the Indo-Trinidadian-based opposition National Alliance for Reconstruction came to power in 1986, there were problems, notably a disagreement between the president and the prime minister, ANR Robinson, over powers of appointment. While Clarke won a court case over one such issue, a second dispute deterred him from seeking re-election for a third term. His time in office had coincided with a period of relative prosperity and social stability. Trinidad and Tobago's oil-based economy flourished between 1972 and 1983, though by 1986, the International Monetary Fund was providing support in return for an austerity programme that resulted in 10% unemployment. On 5 February 1985 Clarke, a devout Catholic, hosted a visit by Pope John Paul II.Clarke remained active in national life, latterly advising on further constitutional reform. In 1993 he told Australia's republican advisory
Abortion in Europe: A right that isn't | Editorial Ireland is only one of several European nations to take a restrictive approach to abortionThe greatest achievement of Europe's human rights framework has been to banish the death penalty from its shores. The same continental unanimity is entirely lacking in other matters of life and death. Europeans may listen in with amusement to the loony tunes that emanate from culture wars of the United States, but on abortion the truth is that they have themselves avoided bitter divisions only by agreeing to disagree. For all the qualifications and attempted reversal, the Roe v Wade decision still provides American women with a right to abortion which has no European counterpart. The position varies wildly across the continent, with Malta banning the practice entirely, and Ireland being almost as restrictive, as a Strasbourg ruling underlined last week. The European court of human rights last week settled the case of three Irish residents who argued that their wellbeing had been jeopardised by their need to travel abroad in order to secure an abortion. Ireland's theocratic strictures on terminations are nothing new. The abortionist Mamie Cadden was sentenced to hang in 1957, and during the half-century since there have been repeat referendums, a constitutional amendment and a run of test cases, but the basic bar remains in full force except in tightly prescribed circumstances, most notably where the woman's life is in danger. This notional get-out clause dates to a 1992 court ruling in the case of a suicidal teenage rape victim but, during the 18 years since then, Dublin's politicians have refused to tidy up the position, and this minimal theoretical right remains in a practical limbo, for the most part effected only by pregnant women taking a trip to Britain. All three of the women
Turkey's quiet revolution | Editorial Turkey is moving closer to Europe in its democratic standards and economic governance, which should be applaudedNothing can take place in Turkish politics these days without the opposite inference being drawn. A referendum on a package of 26 constitutional amendments won approval by a wide margin with a vote of 58% on a high turnout of 78%. The prime minister Recep Tayyip Erdogan was undoubtedly right to claim that his reform package had got popular backing. And yet those who had predicted a tighter margin of victory continued to claim yesterday that the result was polarising. The amendments addressed a human rights agenda more than they did an Islamist one – they expanded the constitutional court and supreme board of judges, strengthened the rights to equality, privacy, collective bargaining and child protection, expanded the jurisdiction of the civilian court over the military one, and ended immunity from prosecution to the junta that ruled Turkey after the last coup in 1980. But still Erdogan's opponents claim that his real purpose is to exert more control over the judiciary himself. By changing the way the top courts are set up, the opposition argues that the ruling Justice and Development party (AKP) aims to bring them under its control. There is scant evidence for the fear that the AKP, once it is secure in power, could turn Turkey into a radical Islamist state and, for this reason, Erdogan's allegedly hidden agenda is always due to be enacted some way off into the future. The Turkish leader has changed his views on the EU and Nato, both of which he opposed in speeches in the 1990s, and he thinks democracy is a means to an end, not an end in itself. But rather than seeing dark designs in a leader who is both pro-European and a moderniser, it would be fairer to judg

George Monbiot | General election 2010: Grasp the opportunity for reform With no clear winner, the people's verdict is a plague on the old politics. Now is the time for real reform of our broken systemSo now the real fight begins. If, as seems almost certain, we are to have a hung parliament, the UK's locked-down politics has suddenly been flung wide open. For the first time in living memory, we have a chance to smash our antediluvian system. If we can seize the opportunity a hung parliament offers, to deliver proportional representation and party-funding reform, we will change politics in the UK for ever. Now we have the chance to be counted: metaphorically and literally. Our votes need never be wasted again. But it won't happen by itself: nothing ever does. We will change this system despite most of the men and women who have just taken seats at Westminster, not because of them. Radical constitutional reform will happen only if we demand it, so loudly and so doggedly that parliament and government, whatever their composition might be, can no longer fend us off.The fight starts tomorrow, with rallies in London, Glasgow, Manchester, Bristol, Middlesborough, Oxford and possibly other cities. It is being coordinated by the kind of wide-ranging coalition we've needed for years, as almost all the major reform campaigns – Power2010, Make Votes Count, Unlock Democracy, the Electoral Reform Society, Ekklesia, Compass, Hang 'em, Vote for a Change and others – have settled their differences and come together. (The only name missing from the list is 38 Degrees, which appears to have decided that its real enemies are other democracy campaigns.) Most encouragingly, some of the big environment groups – Greenpeace, Friends of the Earth, the New Economics Foundation – have joined the coalition, knowing that much of what they hope to achieve is impossible und
