    • which has the real financial sense?
      most companies would stress on that as the risk of economics meltdown or even crisis as there have been in the past couple of year, the lay off regulation which currently requires strict terms to be satisfied should be deregulated. because it makes a financial sense for employers to make their expenditure more flexible to modify as salary is the most impact on it as a fixed cost. this is also related to stability of the company management which in longer term more people can be benefited even if there could be some lay-off in the short term. this argument is based on the premise that as there are some uncertainties in real economy, the wages paid to employees should also be flexible to be adjusted that situation. however there are several assumptions that may not necessarily apply to this argument. for example, the costs paid to employees as a salary must outweigh the costs associated with compensation to be paid for laid off employees. also, one must look at the plausibility of flexibility of expenditure or stability of the company management. the first issue to be addressed is whether labor costs justify large capital expenditures to compensation for laid off employees. clearly one could argue that if the amount of a compensation to be paid laid off employees will be an exorbitant amount of money in comparison to the amount of saving labor costs would not make sense to, for example, lobby for lay off deregulation. if the amount of compensation for laid off employees would come to jpy 1billion versus the saving labor cost jpy 100mln per year, it would make financial sense to simply keep a contract of employment. to consider this, a cost benefit analysis must be made. i also feel that although that analysis should be the determining factor with regard to these decisions making financial sense, it may not be the determining factor with regard to making social, moral and ethical sense. this argument also relies on the idea that companies solely use financial sense in analyzing improving the work environment. this is not the case. companies look at other considerations such as the negative intangible ramifications of overworking. for example, last week a group of ex-employees in jal (japan air line) such as pilots, flight attendant and other personnel whose the number comes to around 140 is set to file against the company, insisting they were unduly dismissed as part of the company's restructuring efforts. this is not only financial matter that jal owe them to pay as a compensation, but also reputation matter meaning that confrontation between manager and ex-employees has been made public. finally one must understand decreasing the number of employee is not only the way to reduce expenditures. alternatives could be such as a new contract that it has higher proportion between company earnings and waged to be paid to employee or selling assets/subsidiaries related to relatively lower earnings, etc.. in conclusion, while at first it may seem to make financial sense to make the low deregulated which enable employers to cut employees easily in order to make their expenditure more flexible to modify as adjusted to company earnings sometimes it actually does not. furthermore, financial sense may not be the only issue a company faces. other types of analyses must be made such as the social or reputation ramifications of an stability of its head count. before any decision is made, all this things must be considered, not simply the reduction of expenditures.
